With the elections fast approaching, GVC has received a lot of calls/emails about political signs in HOA governed yards. Here is a simplified version of Arizona Title 33-1808, Section C that GVC has shared with HOAs.
Most HOAs in Green Valley have a CC & R prohibiting signs except “for sale” signs of a certain size or type. Arizona statutes, which supersede all HOA regulations, provide that indoor or outdoor political signs must be allowed in HOAs for the 71 days prior to the day of the election and removed within 3 days after the election. The HOA can regulate the size and number of signs as long as the regulation is no stricter than those of the governing body of the area. The aggregate square footage of all the signs in one yard can be limited to a total of 9 square feet if the governing body has no different restrictions. Political signs are defined as signs that attempt to influence the outcome of an election, including supporting or opposing a candidate or a recall of a public officer. It also includes signs supporting or opposing a ballot measure, question or proposition. It does not include signs supporting/opposing/espousing a societal issue.
